Welcome to Oceanside Seafood. By accessing or using our website, you agree to be bound by the following Terms of Service. These Terms apply to all users of the site, including customers, browsers, and merchants.

1. Online Store Terms

By using this site, you confirm that you are at least the age of majority in your state or have given consent for any minor dependents to use this site.

You agree not to use our products for any illegal or unauthorized purpose.

2. Product Nature & Perishable Goods

All Oceanside Seafood products are perishable food items.

By placing an order, you acknowledge and agree:

  • Products are shipped frozen using dry ice and insulated packaging
  • Product quality depends on proper handling after delivery
  • Natural variation in size, weight, color, and texture may occur
  • Product images are for reference only

We guarantee products leave our facility in excellent condition, but we cannot control conditions after delivery.

3. Shipping, Delivery & Risk of Loss

We ship using third-party carriers (including UPS) and utilize cold-chain packaging.

Responsibility Transfer

All risk of loss and responsibility transfers to the customer upon confirmed delivery.

This includes:

  • Packages left unattended
  • Delayed retrieval
  • Incorrect shipping addresses
  • Theft after delivery
  • Carrier delays or rerouting

Customers are responsible for being available to receive deliveries and for immediately refrigerating or freezing all products.

Failure to properly handle perishable goods may result in denial of refunds or replacements.

4. No Guarantee of Transit Time

Delivery dates and transit times are estimates only and are not guaranteed.

Oceanside Seafood is not liable for delays caused by carriers, weather, mechanical issues, or other factors outside our control.

5. Carrier Liability & Cold Chain Disclaimer

We take extensive measures to ensure products remain frozen during transit, including insulated packaging and dry ice.

However, you acknowledge:

  • We do not control carrier handling or timing
  • Minor thawing during transit does not automatically constitute product failure
  • Products may safely thaw partially while remaining suitable for consumption

Carrier-related delays or temperature changes do not automatically qualify for refunds.

6. Delivery Issues & Claims

All claims must be submitted within 24 hours of confirmed delivery.

To evaluate claims, we may require:

  • Photos of product condition
  • Photos of packaging and label
  • Description of the issue

We reserve the right to deny claims that:

  • Are submitted after 24 hours
  • Lack sufficient documentation
  • Show improper storage after delivery

7. Order Acceptance, Limits & Cancellation

We reserve the right to refuse, limit, or cancel any order at our discretion.

Orders may be canceled due to:

  • Suspected fraud
  • Inventory constraints
  • Pricing or system errors
  • Fulfillment limitations

8. Pricing & Payment

All prices are listed in USD.

We reserve the right to:

  • Modify pricing at any time
  • Correct errors, including after order submission

Submission of payment does not guarantee order acceptance.

9. Chargebacks & Fraud Protection

By placing an order, you agree to contact Oceanside Seafood prior to initiating a chargeback.

We actively dispute fraudulent or abusive chargebacks using:

  • Carrier delivery confirmation
  • Tracking records
  • Order documentation
  • Packaging and shipping methods
  • Customer communication

Accounts associated with abusive chargebacks may be permanently restricted.

10. Subscriptions (If Applicable)

By enrolling in a subscription, you authorize recurring charges.

  • Changes or cancellations must be made prior to billing
  • Orders processed before cancellation may still ship

11. Force Majeure

Oceanside Seafood shall not be liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to:

  • Weather events
  • Natural disasters
  • Carrier disruptions
  • Supply chain interruptions
  • Labor shortages
  • Power outages

12. Limitation of Liability

To the fullest extent permitted by law, Oceanside Seafood shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss due to improper handling after delivery
  • Carrier delays or service failures

Our total liability shall not exceed the amount paid for the product.

13. Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to your use of this site or purchase of products shall be resolved through binding arbitration, rather than in court.

  • Arbitration shall be conducted in the State of Michigan
  • The decision of the arbitrator shall be final and binding
  • Each party shall bear its own costs unless otherwise determined

14. Class Action Waiver

You agree that any dispute resolution shall be conducted on an individual basis only.

You waive the right to participate in:

  • Class actions
  • Class arbitrations
  • Representative proceedings

15. Governing Law

These Terms are governed by the laws of the State of Michigan.

16. Changes to Terms

We reserve the right to update these Terms at any time. Changes take effect upon posting.
